At Dr. Mete Aksu's practice, we respect the privacy of your private life and value the security of personal data.
For this reason, in order to protect your personal data, we wish to inform you about how your personal data is collected, the purposes and legal grounds for its processing, and your rights regarding its use and protection under Personal Data Protection Law No. 6698 (the Law), which was published in the Official Gazette on 7 April 2016 and entered into force on 1 December 2019.
Our purpose, as Dr. Mete Aksu, defined as the “Data Controller” under the Law, is to establish the terms and conditions for the use of personal data shared with Dr. Mete Aksu by members, visitors and users of the website www.meteaksu.com.tr (the “Website”), which we operate, and by persons who receive or will receive examinations and treatment at our medical centers, referred to as Data Subjects under the Law, as well as personal data generated by Dr. Mete Aksu during the Data Subject's use of the Website.
a. Conditions for Processing Personal Data and the Personal Data to Be Processed
The Law defines Personal Data as “any information relating to an identified or identifiable natural person.” As a rule, personal data cannot be processed without the Data Subject's explicit consent. However, Article 5 of the Law provides exceptions under which personal data may be processed without the Data Subject's explicit consent. These exceptions are:
Where processing is expressly provided for by law.
Where processing is necessary to protect the life or physical integrity of the person concerned or another person, and the person concerned is unable to express consent due to practical impossibility or their consent has no legal validity.
Where processing the personal data of the parties to a contract is necessary, provided that it is directly related to the establishment or performance of the contract.
Where processing is necessary for the Data Controller to fulfill a legal obligation.
Where the data has been made public by the person concerned.
Where processing is necessary to establish, exercise or protect a right.
Where processing is necessary for the legitimate interests of the Data Controller, provided that it does not harm the fundamental rights and freedoms of the person concerned.
Dr. Mete Aksu may process the Data Subject's personal information through the Website or manually, subject to the Data Subject's consent. This includes identity information, contact details such as email address and telephone number, and other information deemed personal data under the Law and all relevant legislation that may be necessary to provide the services offered through the Website and any prospective healthcare services. The user acknowledges that they explicitly consent to the processing of data they voluntarily share with Dr. Mete Aksu, within the scope and for the purposes specified in this “Information Notice.”
Data that has been irreversibly anonymized will not be considered personal data under Articles 3 and 7 of the Law, and processing activities concerning such data will be conducted without being subject to the provisions of this Information Notice.
Your personal health data may be processed without your explicit consent for the purposes of protecting public health, preventive medicine, medical diagnosis, treatment and care services, and planning and managing healthcare services and their financing.
b. Our Purposes for Processing Your Personal Data
Enabling the Data Subject to benefit from the services provided through the Website;
Conducting the assessments necessary for the healthcare service provided;
Carrying out the necessary work by the relevant business units to provide healthcare services and monitor treatments conducted by Dr. Mete Aksu as Data Controller, and managing the associated business and treatment processes;
Ensuring the legal, technical and commercial/business security of Dr. Mete Aksu and those with whom he has business relationships, and planning and implementing Dr. Mete Aksu's commercial and/or business strategies;
Conducting the work required by the business units to enable the relevant Data Subject to benefit from our healthcare services, and managing the related business processes;
Creating a membership registration and account in the event of membership of the Website, and maintaining the related records;
Identifying Website system errors, monitoring performance and improving operation, and providing maintenance, support and backup services;
Providing better and more reliable services to Data Subjects;
Personal data will be processed for these purposes within the conditions and purposes for processing personal data specified in Articles 5 and 6 of Law No. 6698.
In addition to the purposes stated above, your personal data may be used to contact you regarding healthcare services and treatments specific to you, improve your experience on the Website, support reporting and business development activities within the medical center, and carry out various statistical assessments without disclosing your identity. If you have also given permission, your data may be processed for promotional activities, service offers, marketing and campaigns, developing services and treatments suited to you, conducting Data Subject satisfaction studies, identifying target Data Subject groups, and similar purposes.
This information may be processed and stored by Dr. Mete Aksu and shared with his partners for direct marketing, digital marketing, remarketing, targeting, profiling and analysis. You may be contacted using this information to promote various applications, products and services, and to provide notices concerning maintenance and support activities.
In addition, with the Data Subject's explicit consent, Dr. Mete Aksu may, for the purposes of:
Obtaining a clearer visual record of patients' treatment processes;
Developing and improving the healthcare services we provide;
Analyzing the Data Subject's use of healthcare services and storing health data;
Conducting legal proceedings and handling complaints;
Capture images and recordings before, during and after the healthcare services provided to patients, and process them in accordance with Basic Law on Health Services No. 3359, Decree-Law No. 663 on the Organization and Duties of the Ministry of Health and its
Affiliated Institutions, the Regulation on Private Healthcare Institutions Providing Outpatient Diagnosis and Treatment,
the Personal Data Protection Law, the Regulation on the Processing and Privacy of Personal Health
Data, Ministry of Health regulations, decisions of the Personal Data Protection Board, and other relevant legislation.
c. With Whom Personal Data Will Be Shared and for What Purposes
Your personal data may be transferred to third parties whose services Dr. Mete Aksu uses to provide services to the Data Subject, within the limits established by relevant legislation, particularly the Basic Law on Health Services, and only as necessary to fulfill the purposes stated above and the obligations imposed by relevant legislation. Dr. Mete Aksu may share your data with third parties such as outsourced service providers, including email and SMS providers, hosting service providers, judicial authorities, law firms, research companies and call centers, in order to develop the Data Subject's experience, including improvement and personalization, ensure security, detect fraudulent or unauthorized use, conduct operational assessment research, resolve errors in Website services and legal issues, and achieve any of the purposes set out in this Information Notice.
The Data Subject acknowledges and gives advance explicit consent that the third parties referred to above may store their personal data on their servers, limited to the purposes stated above.
Your personal data may be transferred abroad for processing, storage, administration or any other use specified in this Information Notice, without requiring the Data Subject's explicit consent, within the procedures and conditions indicated in Article 9 of the Law.
d. Method and Legal Basis for Collecting Personal Data
Your personal data is collected electronically through the Website and social media, and manually at our medical centers. Personal data collected through these methods may be processed and transferred within the conditions and purposes for processing personal data specified in Articles 5 and 6 of the Law, and for the purposes stated in sections (b) and (c) of this Information Notice.
e. Rights of the Personal Data Subject Under the Law
Under Article 11 of the Law, the Data Subject has the right to:
Learn whether their personal data is being processed;
Request information about the processing if their personal data has been processed;
Learn the purpose of the processing of their personal data and whether it is being used in accordance with that purpose;
Know the third parties to whom their personal data has been transferred within Türkiye or abroad;
Request the correction of incomplete or inaccurate personal data, and request that third parties to whom the personal data has been transferred be informed of the action taken;
Request the deletion or destruction of personal data when the reasons requiring its processing cease to exist, even if it has been processed in accordance with Law No. 6698 and other relevant laws, and request that third parties to whom the personal data has been transferred be informed of the action taken;
Object if they believe that a result to their detriment has arisen from the analysis of their processed data exclusively through automated systems;
Request compensation for damage suffered as a result of unlawful processing of their personal data.
If you submit requests to exercise these rights to Dr. Mete Aksu through a notary public or registered mail with return receipt, in writing by email to info@meteaksu.com.tr from an email address previously provided by the applicant to Dr. Mete Aksu and registered in his system, or through other methods determined by the Personal Data Protection Board, Dr. Mete Aksu will resolve the request free of charge as soon as possible and within thirty days at the latest, depending on its nature. However, if the procedure entails an additional cost, Dr. Mete Aksu will charge the fee specified in the tariff determined by the Personal Data Protection Board.
f. Retention Period for Personal Data
Dr. Mete Aksu will retain personal data provided by the Data Subject throughout the period in which services and treatment are provided, in order to fulfill the obligations arising from the nature of those services. In addition, in the event of any dispute with the Data Subject, Dr. Mete Aksu may retain personal data for the limitation periods specified under relevant legislation, solely to prepare the necessary defenses in relation to the dispute.
g. Changes to This Information Notice
This Information Notice may be updated to reflect changing circumstances and legislation.
